With 30 years’ experience working in and managing business, Andrew Smyth is sought after by industry and commerce for his specialist knowledge in structuring, regulatory compliance and business succession planning and SMSFs.  Andrew value adds to his clientele with his passion for technology and cybersecurity expertise.  Recognised by industry for this expertise in this field, he regularly advises the legal profession and commercial clients on conducting business in the complex cyber world.

Andrew is the Managing Partner of the firm, and the partner in charge of the litigation section of the firm. He has practiced extensively in all areas of litigation, particularly commercial disputes, family law, and estate litigation. He is an author of the Australian reference text “Estate Planning”, published by LexisNexis.

Andrew provides specialised assistance to commercial clients, business owners, and entrepreneurs, advising on and documenting arrangements for Asset Protection, Trusts, Estate Planning, Complex Wills, Superannuation and Instalment Warrants. He also advises both clients and members of the legal profession about the legal issues arising at the intersection between the Law and Information Technology.

ABOUT MARCUS WOODFIELD
Partner of Property and Commercial Law Divisions

Marcus was admitted as a solicitor of the Supreme Court of Queensland in 1993 after graduating from the Queensland University of Technology with a Bachelor of Laws. He is also a solicitor of the High Court of Australia. Marcus commenced employment with a Gold Coast law firm in 1987 and then moved to another Coast firm in 1990 where he remained for 10 years. He joined Robbins Watson in 2000, was appointed associate to the firm in 2002, and was appointed partner in 2004. Marcus has extensive experience in all areas of law and has particularly concentrated on the commercial area. In particular, Marcus has developed a busy franchising law practice, acting for both Franchisees and Franchisors in a vast array of industries. Marcus is a delegate member of the Franchising Council of Australia.

Marcus also has a busy practice in the transfers of businesses – acting for either Vendor or Purchaser, and taking care of the important, but tricky, details like restraint against future competition, the terms of the lease in which the business is conducted, and, of course, the stamp duty implications of any sale. He has acted for developers of large property developments on the Gold Coast and for landlords and tenants of large shopping centres.

General conveyancing has been a major part of Marcus’ work over the years where he has developed an excellent rapport with clients with his down to earth and amiable manner. Marcus has also practises heavily in the field of wills and estates where he has a particular interest in helping people at often difficult times. Whilst concentrating on commercial law Marcus has also had extensive experience in other areas of law, particularly personal injuries claims, and in November 1999 he obtained the then highest ever payout for a claimant in Queensland, being $6.5 million. Marcus likes to have a hands on approach to all of his work and prides himself on giving his clients the correct advice in a clear and easy to understand manner. He believes that prevention is better than cure and his experience in litigation enables him to identify potential problems in a commercial or property transaction and to take steps to prevent such problems from occurring.

Alexandra is an experienced conveyancing and property lawyer as well as having experience in family law, wills and commercial matters.  Before her admission in 2018 she gained a wealth of varied experience in law, business and life. She has been a professional athlete,  worked in a range of roles building and maintaining professional and productive relationships with colleagues and clients, as well as leading and managing staff.

Alexandra has a passion for her profession and enjoys helping clients and providing results.

ABOUT EMMA POST

Emma graduated with a Bachelor of Laws in 2018 from Griffith University. Since graduating, Emma has completed her Graduate Diploma of Legal Practice with the College of Law and is on track to be admitted as a solicitor in February 2021.

In 2012, Emma completed her high school work experience with Robbins Watson, and in 2020, Emma returned to the firm to complete her practical legal training with the Property and Commercial team under the supervision of Partner, Marcus Woodfield.

Emma began her legal career working in house for an international clothing brand where she gained experience in commercial leasing, contract review and drafting, including licensing agreements, terms and conditions, employment contracts, and athlete and influencer agreements. Emma also assisted senior legal counsel in navigating company structures, intellectual property infringements, and insolvency.

Since working at Robbins Watson, Emma has developed a strong focus on property transactions, where she has assisted supervising solicitors in a number of commercial, residential, and off the plan purchase and sales. Emma primarily assists in drafting and reviewing Real Estate ADL/REIQ Contracts, commercial leases, Land Registry forms, Deeds, and amending company restructuring and share sale agreements, hire agreements, and loan agreements.

Emma is client focused, attentive to detail, and excited to continue her career in the property and commercial arena.
