Inheritance Law

The passing of a loved one is a devastating and sad reality we will all face.

It is also one of the more legally challenging and risk-prone areas of law. 

  • The duties of the executor or administrator are complex and demanding.  Even in the closest families, uncertainties, fears, and the emotions of the circumstances produce a difficult environment for the members of the extended family, and all too often old family disputes return, placing added pressure upon all affected.
  • Merely interpreting the will can be difficult, particularly where there is either a home-made will, or, perhaps, merely some informal looking notes as to what were the deceased's wishes.  These days, those notes may be found to be a will!
  • The legal system permits claims to be made by those who consider that 'inadequate provision' has been made for them in the will, and, of course, all creditors of the estate must be checked, and either settled or disputed.
  • Once all of these rocky waters have been navigated, there is still the process of selling and/or transferring assets to the rightful beneficiaries, a process which itself can be challenging.
